A Grantsburg man has been charged with eight felony counts linked to a cell phone that had video footage of minors without their consent.

In December Grantsburg Police Department reached out to the Wisconsin Department of Criminal Investigations (DCI) after finding a phone with videos and images being taken of juveniles without their consent.

Special Agent Theodore Indermuehle took the stand last week to testify in the preliminary hearing in a felony case revolving around alleged child pornography.

Johnny Massey, 33, Grantsburg has been charged with eight felony counts including two counts of child sexual exploitation and two counts of possession of child pornography.

He was transported from Barron County Jail where he is currently being housed on $10,000 cash bond because the Burnett County Jail is often full.

SA Indermuehle testified that Massey told him during an interview that the camera capturing video of the shower because he believed people were stealing his shampoo.

District Attorney Jim Rennicke then asked if in any of the clips he reviewed showed anyone attempting to steal shampoo and Indermuehle responded that none of the clips showed anyone stealing shampoo.

Indermuehle stated there were both videos and still images of two juveniles. During the investigation Indermuehle came to believe the juveniles in the video and images were a 14-year-old girl and an 11 or 9-year-old boy. Indermuehle was uncertain at the hearing of the boy’s age.

Indermuehle stated in the video he saw the “vaginal area and exposed breasts” of the juvenile girl. Indermuehle added the video appeared to be taken without her consent.

He also stated while testifying that there were a number of regular photos of Massey on the phone along with the explicit images.

Massey’s attorney, Renee Taber said she would be filing a motion to dismiss four of the eight felony counts because they state elements must include sexually explicit behavior. Taber said there is no evidence showing sexually explicit behavior in the images.

According to the criminal complaint, authorities were made aware of a cell phone with images of naked juveniles. The phone allegedly contains video of a juvenile girl preparing and then getting into the shower and a juvenile boy using the toilet.

The complaint states the filming took place in two different residences in the Village of Grantsburg.

There is a motion hearing in the case scheduled for March 17 and Massey remains in custody on $10,000 cash bond.
